Welcome to HealthUnlocked.

This Privacy Notice (“Notice”) explains how Personal Data is collected, used, shared, and protected when you interact with HealthUnlocked websites, platforms, and services (together, the “Services”). It also explains your privacy rights and how you can exercise them.

HealthUnlocked is part of the Thermo Fisher Scientific group of companies (“We”). We aim to transform individual health experiences into support, recommendations, insight and understanding for people facing similar challenges, and increase awareness about, and facilitate participation in, clinical trials. We do this by enabling people to share on our site personal health experiences and information with people with similar health conditions online, learn about research, and clinical studies, be matched with relevant research opportunities, be contacted about them, and receive opportunities that may support health and well-being.

At HealthUnlocked, we believe shared experiences can transform lives and deepen understanding of health. Because this may involve you sharing sensitive information about your health, we also believe in the importance of clear and transparent privacy guidelines.

2. The purpose and reach of this privacy notice 

This Notice describes the types of Personal Data that may be collected or processed as part of our Services, how we may use and disclose that Personal Data, and how you may exercise any rights you may have regarding our processing of your Personal Data.

This Notice applies to Personal Data collected or processed by us through HealthUnlocked websites, applications, patient communities, research profiles/portals, email communications, and other online or digital channels. It also applies where we process your Personal Data in connection with your use of patient communities; your creation and use of a research profile; your potential participation in research studies or clinical trials, including recruitment and pre-screening activities; and our communications with you about research opportunities, services, or platform functionality.

This Notice further applies where we process Personal Data relating to healthcare professionals for the purpose of recruitment activities, including sharing recruitment materials, and where we process Personal Data relating to employees or representatives of patient community partners in connection with our business relationships.

This Notice applies in any other situations where you interact with us in connection with the Services, including when you contact us, participate in surveys, or otherwise communicate with us online, by telephone, or by mail.

·      It is important that you read this Notice (together with any other privacy notice or fair processing notice we may provide on specific occasions when we are collecting or processing Personal Data about you) so that you are fully aware of how and why we are using your data. This Notice supplements other notices and is not intended to override them. 

·      If you provide us with Personal Data of anyone other than yourself (such as a patient or family member), please note that you are responsible for complying with all applicable privacy and data protection laws prior to providing that information to us (including obtaining consent, if required).

·      To the extent permitted by applicable law, by providing us with your Personal Data or otherwise interacting with us, you are agreeing to this Notice.


Depending on how you use our Services, HealthUnlocked and other entities may be responsible for the collection and use of your Personal Data (known in some jurisdictions as the “Data Controller”):

•                              When you use our Services to participate in patient communities or to create and manage an account, your Personal Data is generally processed by HealthUnlocked. In some cases, organisations that manage specific communities on our Services (“Community Partners”) may also act as Data Controllers, for example where they process Personal Data for moderation or community management purposes.

HealthUnlocked Holdings Limited is registered in England and Wales under company number 6596274, with its registered office at 3rd Floor, 1 Ashley Road, Altrincham, Cheshire WA14 2DT, United Kingdom.

•                              When you use our Services to explore research or clinical study opportunities,   including where you provide information so that we can assess your potential eligibility for current or future studies conducted by our pharmaceutical clients (“Client(s)”) and contact you about relevant opportunities, or where we interact with you in your capacity as a healthcare professional for the purpose of supporting clinical study recruitment, responsibility for your Personal Data includes HealthUnlocked and may also extend to Pharmaceutical Product Development, LLC (“PPD”) and other Thermo Fisher Scientific affiliates involved in study recruitment (such as AcurianHealth, TrialMed, or Synexus).

3. Information collected

What is Personal Data?

·      “Personal Data” is any information - as electronically or otherwise recorded - that can be used to identify a person or that we can link directly to an individual, such as name, address, email address, telephone number, or credit card number, as applicable. Personal Data in some jurisdictions can include information that indirectly identifies a person, such as a unique number assigned to a patient by a Healthcare Provider or a clinical trial participant, even absent other identifying information.

·      Personal Data may include information considered sensitive in some jurisdictions, such as biometric information, genetic information, medical and health information, financial account information, geolocation, ethnic or racial origin, information concerning your sex life or your sexual orientation, and other information. Please note that, for patients, as described below, we may receive information about you from your Healthcare Provider or others, when legally permitted.

·      We will process any Personal Data we collect in accordance with applicable law and as described in this Notice (unless, as explained above, a separate policy or notice governs). In some circumstances, if you do not provide us with your Personal Data, Services may be unavailable to you.

This section explains, by data subject category, how we collect, process, and use Personal Data, the potential recipients of your Personal Data, and how we have done so in the preceding 12 months. Some jurisdictions require us to state the legal bases for processing your Personal Data, which are included below, but please note that not all jurisdictions may recognize all legal bases.

A. Users of Services (Members), Website Visitors, Survey Participants, and Senders of Inquiries

We may process your Personal Data when you: (1) visit our websites; (2) submit inquiries to us both online (e.g., via email) or offline (e.g., by written letters); (3) sign up for our newsletters or other informational or marketing materials; (4) contact us through online chat available on our websites; (5) participate in surveys we send you; (6) register for, visit, or use our Services.

We may use your Personal Data to assess whether you could be eligible to participate in a current or future clinical study conducted by us or by our Clients and may contact you to provide information about the study.

Please note that once you express interest in a specific study that we administer on behalf of our Client, the Client acts as the Data Controller for the processing of your Personal Data in connection with the recruitment and eligibility assessment for that study. In this context, we process your Personal Data solely on the Client’s instructions and for the purposes of conducting the study (referred to in some jurisdictions as acting as a “Data Processor”). Further details about how your Personal Data is collected, used, and shared in connection with the study are set out in the Client’s privacy notice, which will be made available to you.

C. Healthcare Providers

We may process your Personal Data to contact you in your capacity as a healthcare professional for the purpose of supporting clinical study recruitment. This may include contacting you to raise awareness of relevant clinical studies, whether sponsored by us or conducted by us on behalf of our Clients, for your patients.

·      Professional and educational information, such as: job title or position, employer, national Provider Identifier number, state medical license number, work skills, employment history, graduate degrees, certifications, areas of specialization, responses to surveys and questionnaires, information about diseases in which you may have worked or treatments you may have used, the settings in which you practice

·      Anonymized / De‑identified Data: is data for which your individual personal characteristics have been removed such that you are not identified and the information is no longer considered Personal Data under data protection laws*

Please note that where one of your patients who is a potential Clinical Study Candidate has shared your contact details with us, to request additional information necessary to assess or support that patient’s potential participation in a dedicated study run by our Client, the Client acts as the Data Controller for the processing of your Personal Data to contact you. In this context, we process your Personal Data solely on the Client’s instructions (referred to in some jurisdictions as acting as a Data Processor). Further details about how your Personal Data is collected, used, and shared in connection with the study are set out in the Client’s privacy notice, which will be made available to you.


D. Clients, Business Partners, Patient Community Partners and their Employees, Agents, and Contractors

We may process your Personal Data when you act as a Client or business partner such as a vendor, supplier, distributor, retailer, or service provider.

·      Technical Information, such as: Internet Protocol (IP) addresses (which may identify your general geographic location or company), browser type and browser language, device type, advertising IDs associated with your device (such as Apple’s Identifier for Advertising (IDFA) or Android’s Advertising ID (AAID)), date and time you use our Services, Uniform Resource Locators, or URLs (i.e., website addresses) visited prior to arriving and after leaving our Services, information contained in your communications to us, such as emails to or online chats with customer service,  data collected from cookies or other similar technologies, geolocation information

F. Children’s Data

Our Services are not intended for anyone under the age of 18, and we do not knowingly collect Personal Data relating to children.

If you are under the age of 18, you are prohibited from creating an account or using the Services. By registering or using the Services, you represent that you are at least 18 years old. If we become aware that Personal Data relating to a child has been collected, we will take steps to delete such information in accordance with applicable law.


*We will not attempt to re-identify you or anyone else from this Anonymized Data / De-identified Data, and if we disclose it to third parties, we will require that they commit to not attempting to re-identify you or anyone else from the Anonymized Data / De-identified Data. Anonymized Data / De-identified Data includes health information resulting from the removal of identifiers from protected health information required under the Health Insurance Portability and Accountability Act, 45 CFR § 164.514(b)(2). Please note that in the course of research, study doctors and authorized personnel may still have access to named subject records collected for such research.

**In limited circumstances, recipients may include, (1) in the event of a sale, assignment, or transfer, to the buyer, assignee, or transferee; and, (2) government or regulatory officials, law enforcement, courts, public authorities, or others when permitted by this Notice or required by law.

4. Marketing, Cookies, and Tracking Technologies

Marketing Uses, Cookies, and Other Activities

To the extent permitted by applicable law, including in accordance with your consent where required by applicable law, we may engage in the following activities:

·      We may use your contact details, technical, usage and profile data to form a view on what we think you may want or need, what may be of interest to you. This is how we decide which services and offers may be relevant for you (we call this marketing) and to send you marketing communications. If you do not wish to receive such marketing communications, you may opt out by declining them when registering or in our subsequent communications by following opt-out instructions included in the communication or bycontacting us[CS1] or changing your communication preferences in thesettings[CS2] area of your account or by writing to inform us that you wish to be removed from our contact list.

·      We may display advertisements to you regarding the Services that we believe are relevant to you based on your activities. Such advertisements may be shown on our Services or the online services of others. We achieve this by using, and allowing third parties (e.g., Facebook, LinkedIn) to use certain cookies, eTags, pixels, web beacons, and other tracking technologies to track your activities on our Online Services and other online services. ·      We also perform statistical analyses of the users of our Services to improve the functionality, content, design, and navigation of the Services.

Interactive Features of Our Services

For public or group forums on our Services, such as newsfeeds, blogs, message boards, or similar tools (“Interactive Features”), the posts or comments you make may be public and viewed by others. You should use care before posting information about yourself, including Personal Data. You acknowledge and understand that you have no expectation of privacy or confidentiality in the content you submit to Interactive Features over the Services. Except when required to do so by applicable law, we assume no obligation to remove Personal Data you post on our Services, and your disclosure of any Personal Data through the Interactive Features is at your own risk.

5. Third Parties

We may disclose Personal Data to third parties in accordance with this Notice, including:

·      Thermo Fisher Scientific group of companies

·      Clients, including where we perform recruitment activities on their behalf

·      Clinical trial sites

·      Service providers and vendors acting on our instructions

·      Patient community partners and research collaborators, where applicable

·      Regulatory authorities, courts, and law enforcement, where required by law

·      In the event of a merger, sale, joint venture or other transaction involving a transfer of our business or assets, we may transfer your information to other parties involved in the transaction.

All third parties are required to protect Personal Data and process it in accordance with applicable laws and contractual obligations and will only process Personal Data as necessary to perform their functions in a manner consistent with this Notice, other applicable privacy notices, and as explicitly permitted or required by applicable laws, rules, and regulations. Third parties may be located in the United States and other jurisdictions.

Combination of Data with Data received from Third Parties

We may combine information we collect, whether Personal Data or not, with Personal Data that we may obtain from third parties.

Links to Other Websites

Our Services may contain links to other websites, applications, or services that are not owned or operated by us, such as social media websites and applications. You should carefully review the privacy policies and practices of other websites and services as we cannot control and are not responsible for privacy policies, notices, or practices of third-party websites, applications, and services.

6. Your rights regarding your Personal Data

Depending on your location and applicable law, you may have rights regarding your Personal Data, including the right:

·       To request access to and a copy or representative summary of your Personal Data;

·       To request that we rectify or erase your Personal Data;

·       To request that we restrict or block the processing of your Personal Data (including to object to the sale or sharing of your Personal Data under other relevant laws);

o   This includes the right to opt-out of solicitations, to opt-out of sharing your Personal Data for cross-context behavioral advertising or, in certain other U.S. states, to opt-out of targeted advertising;

·       To provide your Personal Data directly to another organization, i.e., a right to data portability;

·       When we previously obtained your consent, to withdraw consent to processing;

·       To request to know about the Personal Data we process about you or, in other states, to request that we acknowledge our processing of your Personal Data;

·       To request that we limit the processing of your Sensitive Personal Data;

·       To appeal the denial of a request; and

·       To lodge a complaint with the data protection authority in your area.

If you wish to exercise any of the rights set out above, pleasecontact us. For Clinical Study Candidates, you have the right to withdraw your consent to the processing of your information at any time by sending an email to CRGComplianceContact@thermofisher.com. Your withdrawal of consent does not affect the lawfulness of the processing before the withdrawal.

We will make reasonable efforts to respond promptly to your requests in accordance with applicable laws. We may, after receiving your request, require additional information from you to honor the request and verify your identity. Please be aware that we may be unable to afford these rights to you under certain circumstances, such as if we are legally prevented from doing so. 

When we process your Personal Data on behalf of our Client, such as for recruitment activities, we do so in the capacity of a Data Processor. We do not have control over our Clients’ privacy, security practices and processes and we might need to refer your request to them, as appropriate.

7. Transfer of Personal Data across national borders

Please be aware that Personal Data we collect and process may be transferred and maintained outside your country, state, province, or other jurisdiction where the privacy laws may not be as protective as those in your location, including the United States. We have put in place lawful transfer mechanisms and adequate safeguards, in accordance with applicable legal requirements, to protect your Personal Data.

8. Safeguarding information

Consistent with applicable laws and requirements, we have put in place physical, technical, and administrative safeguards to protect Personal Data from loss, misuse, alteration, theft, unauthorized access, and unauthorized disclosure consistent with legal obligations and industry practices.

In order to register with us and become an account holder, you will be invited to provide a password, a username and an email adress. You are entirely responsible for maintaining the confidentiality of your password and account. You will never be required to reveal your full password to any representative or agent of HealthUnlocked. If you forget your password, we may ask you to answer a specific question such as your username or date of birth. Furthermore, you are entirely responsible for any and all activities that occur under your account.

You can choose what information you share with other HealthUnlocked users. If you choose to register using a username which could be used to identify you, or if you share with other HealthUnlocked users other information using HealthUnlocked which allows you to be identified, information you have chosen to share from your profile or contributions, including special categories of Personal Data, could be identified as your data. This may also happen if you upload a photo of yourself, or a likeness of yourself, as a profile picture. Prior to posting any photo or likeness of you, choosing a username that may identify you, and/or posting other information that may identify you, you should carefully consider whether you:

1.                          wish to be identifiable on our site; and

2.                          want to post information that may be capable of being linked to you.

When you do so, and you also make available special categories of data about yourself you will be deemed as having made that data manifestly public.

You agree to notifysecurity@healthunlocked.comimmediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for loss or damage incurred by us or another party due to someone else using your account or password. You may not use anyone else’s account at any time, without the express permission of the account holder. If you think that someone else has access to your password you should change it immediately.

9. How long your Personal Data will be retained

We generally retain Personal Data for as long as needed for the specific business purpose or purposes for which it was collected. In some cases, we may be required to retain Personal Data for a longer period of time by law or for other necessary business purposes. Whenever possible, we aim to anonymize the information or remove unnecessary identifiers from records that we may need to keep for periods beyond the specified retention period.

10. Special note to patients in the United States

If you are a U.S. patient, please note that this Notice is distinct from your Healthcare Provider’s HIPAA Notice of Privacy Practices, which describes how your Healthcare Provider uses and discloses individually identifiable information about your health that it collects, as well as any other privacy practices it applies.

11. Do-Not-Track Signals

Certain web browsers and other programs may transmit “opt-out” signals, also called a Global Privacy Control (or GPC) signal (hereinafter referred to as “GPC Signals”), to websites with which the browser communicates. In most cases you will need to change your web browser’s settings or add an application to your web browser to enable your browser to send a GPC signal. For users that access our websites from U.S. states that have laws requiring recognition of GPC Signals, we will recognize and apply the GPC Signal to inactivate all of the cookies for that website, except for cookies that are necessary for the website to operate (“Strictly Necessary Cookies”). Additionally, if you are accessing our websites from one of these states, you can determine if your browser GPC Signal has been recognized by clicking on the “Your Privacy Choices” link in the footer of the website that will include a short message at the top of the preference center indicating that your GPC Signal has been received. For users from states not currently requiring recognition of the GPC Signal, our website servers may recognize and apply the GPC Signal for only targeted advertising cookies, but will not apply the GPC Signal to functional, performance, or social media cookies.
